PointsBet Holdings Pays AU$500,800 Fine in Spam Penalty, Enters Court Enforceable Undertaking

PointsBet Holdings (ASX:PBH) paid a AU$500,800 spam penalty and is subject to enforceable undertakings after breaching Australia's e-marketing and gambling self-exclusion laws, according to a Friday release from the Australian Communications and Media Authority.

Investigations by ACMA alleged that the company sent more than 800 messages that breached Australia's spam laws.

It is also alleged that the firm delayed closing accounts of customers who had registered and were sending marketing messages to self-excluded persons. It sent seven marketing emails without recipient consent and 90 commercial texts that did not have sender contact information.

The authority found that no excluded customers were able to place bets with PointsBet during the period investigated, and it accepted comprehensive court-enforceable undertakings from PointsBet committing it to reviews into its compliance with spam and the National self-exclusion register laws, actioning any recommended improvements, and providing regular training for all relevant staff.

A failure to comply with an enforceable undertaking can lead to court-ordered financial penalties.
