Monster Beverage's (MNST) jury win in a false advertising case against Vital Pharmaceuticals and its founder John Owoc was upheld by the US appeals court Tuesday.
In its ruling, the 9th US Circuit Court of Appeals rejected arguments that the US District Court for the Central District of California excluded certain evidence that would have helped Owoc's case.
In 2022, a jury found Vital and Owoc liable for false advertising and awarded over $270 million in damages to Monster Beverage as well as issued a permanent injunction barring Vital from promoting its Bang energy drink as containing creatine or super creatine, according to the court document.
