Italian Court Reverses €15 Million Privacy Fine Against ChatGPT Developer OpenAI

A ruling disclosed on Thursday indicated that a court in Rome has overturned a €15 million (approximately $17 million) fine imposed by Italy's data protection authority on OpenAI, the developer of ChatGPT.

The court has not yet released the reasoning behind this decision. OpenAI stated in a declaration, "We welcome the ruling by the Rome court. We remain committed to respecting user privacy and look forward to helping more individuals, businesses, and society in Italy benefit from artificial intelligence." Italy's Data Protection Authority (Garante) declined to comment. The penalty was issued in December 2024, citing alleged unlawful use of personal data by the generative AI application. At the time, OpenAI described the sanction as "excessive" and announced its intention to appeal. In March 2025, the Rome court had temporarily suspended enforcement of the fine pending a ruling on the substantive issues of the case.
